Some compare this age of electronic communication with the arrival of the Gutenberg press, or with the industrial revolution. Yet this revolution, when it has run its course, may have a greater impact on the planet than anything that has preceded. The applications of electronic transmissions are just beginning to be felt... and the breadth and depth of what lies ahead is only beginning to be fathomed. How and where we are educated, where and how we work and live, our health care systems, our shops, our commerce, our reading, our leisure... no part of human enterprise will be spared. A lawyer will often see this as a problem, but it may as well be an opportunity But an opportunity that will give us challenges It is our task as lawyers to ensure that theses opportunities are exploited in ways that will also give sound legal solutions

Noone else can give us the answers It does not make much sense to search for the law as it is – Develop concepts –Analytical models –Etc It is not a matter of technology –We need to peel away the technology to get into the legal concepts

61 © Olav Torvund - SENTER FOR RETTSINFORMATIKK UNIVERSITETET I OSLO http://www.torvund.net Challenges It is hard and difficult –We do not have proper descritions –We tend to end up in unexpectes places and legal concepts –Too many work from what apparently happen –High level = superficial If we do not understand what is happening, the legal analysis is built on sand We have to shift focus from individual transactions to system –Many (human) errors are eliminated –An error in the system => errors in all transactions –Less probability, more severe consequences We have to prevent the errors, we cannot wait for them to happen –Proactive law –We cannot take the traditional case-by-case approach
